In 2026, new services and entities will begin coming under AUSTRAC regulation following reforms to anti-money laundering and counter-terrorism financing (AML/CTF) laws. The reformed laws also impact current reporting entities.

New information gathering powers
The reformed AML/CTF laws include new and updated information-gathering powers for AUSTRAC. The changes to these powers give AUSTRAC the ability to collect and use evidence for specific purposes. These new powers include:
- Section 49B – Notice to obtain information or documents in certain circumstances
- Section 49C – Authorisation to obtain information or documents in certain circumstances
- Section 172A – Power of AUSTRAC CEO to obtain information and documents
Under these new powers, reporting entities may receive a notice from AUSTRAC asking for information or documents that may help us obtain information to combat crime or identify trends or patterns associated with crime.
